    Bihar News: Patna High Court has stayed the reservation of Other Backward Classes (OBC) in the municipal elections to be held in Bihar. Since then, the politics of Bihar has heated up. While the ruling JDU is targeting the central government, the BJP is cursing the state government for this.

    A division bench of Chief Justice Sanjay Karol and Justice S Kumar of Patna High Court, while delivering its verdict on a petition filed against reservation in municipal elections, said on Tuesday that the seats reserved for OBCs have been notified and ordered to conduct elections. The bench also said that the State Election Commission can extend the date of polling if it so desires.

    HC’s decision to stop elections immediately is unfortunate: Kushwaha

    Senior JDU leader and former Union Minister Upendra Kushwaha said that the decision of the High Court to cancel the backward reservation in the ongoing municipal elections in Bihar and stop the elections immediately is unfortunate. Such a decision is the result of a deep conspiracy by the central government and BJP. He said that if the Central Government had completed the necessary constitutional formalities by getting the caste census conducted on time, such a situation would not have arisen today. He said that the JDU will agitate against this conspiracy of the central government and the BJP. The party will announce the program soon.

    Nitish Kumar is against reservation: Sanjay Jaiswal

    On the other hand, BJP State President Dr. Sanjay Jaiswal said that today the whole of Bihar has recognized that Nitish Kumar is against reservation. Till date, whatever reservation has been given to the backward and most backward, it was given by Nitish Kumar in compulsion because of staying with the BJP. He said that the then Deputy Chief Minister Tarkishore Prasad was preparing the reservation roster of all the municipal and municipal council areas, but Tejashwi Yadav and Nitish Kumar deliberately started the process of conducting the municipal elections without making the reservation roster, so that all Bihar seats get into controversy.

    ‘CM should tell why the election process was started without preparation’

    At the same time, BJP OBC Morcha’s National General Secretary and spokesperson Nikhil Anand said that Chief Minister Nitish Kumar deliberately betrayed the backward, the most backward. He said in a questioning tone that Nitish Kumar should tell whose responsibility was to set up the commission. While questioning, he also asked that the Chief Minister should explain why the election process was started without preparation.

    High Court bans reservation of Other Backward Classes in civic elections

    It is worth noting that the Patna High Court, while banning the reservation of Other Backward Classes in civic elections today, said that the Bihar government and the State Election Commission did not comply with the order of the Supreme Court regarding reservation for backward classes. The High Court has observed that the State Election Commission of Bihar has failed to fulfill its constitutional responsibility. The Patna High Court had completed the hearing on September 29 on the petition filed for reservation for the backwards in the civic elections. Today, Chief Justices of the High Court Sanjay Karol and S. Kumar’s bench gave its verdict.

    The court has told the State Election Commission that it has not completed the process of triple test fixed by the Supreme Court for the reservation of backward classes. In the matter of giving reservation in local body elections, the Supreme Court ruled in 2021 that reservation for OBCs in local bodies could not be allowed until the government conducted three investigations prescribed by the Supreme Court in 2010. Does not fulfill the qualification. The triple test formula, which was given by the Supreme Court, had asked to constitute a special commission to collect data on the backwardness of OBCs in that state and to fix the proportion of reservation in each local body in view of the commission’s recommendations.
